General Terms and Conditions (GTC) applicable to the rental of holiday homes under the NASTE VILLAS brand
1. Scope of the GTC
These General Terms and Conditions (GTC) apply to the rental of holiday homes, including the use of winter and summer equipment, under the NASTE VILLAS brand (owner: AK Living Immobilien AG, CH-Lenzburg). The terms mentioned in these GTC, such as landlord, we, us, etc., always refer to the brand. The tenant, guest or guests include all persons staying in the house. Further individual details regarding the respective houses are regulated separately in the rental agreements, which are also subject to these GTC
2. Subject matter of the contract
The services forming the subject matter of the contract are regulated in the corresponding rental agreement.
3. Bookings & enquiries
Bookings must be made through our booking system on the website. Enquiries and requests for further information may be sent to us via the form on the website (www.nastevillas.com), by email (welcome@nastevillas.com), or by telephone or WhatsApp (+41 79 873 50 20). Unfortunately, we cannot consider other contact channels.
4. Rental agreement & rental period
If the vacation home is available, NASTE VILLAS will draw up a rental agreement between the parties. The minimum rental period is either 5 or 7 nights, depending on the season. Further details regarding the start and end dates of the rental are specified in the booking system.
5. Conclusion of the contract
The contract is deemed concluded and legally binding upon booking and payment of the deposit. NASTE VILLAS will then send the tenant a rental agreement, which must be signed by both parties. Our guests will thereafter receive a written booking confirmation
6. Prices
The prices for the respective rental period and season are displayed on the booking portal and are based exclusively in euros (EUR). The price includes Finnish VAT for accommodation. NASTE VILLAS reserves the right to change prices at any time; however, such changes do not affect contracts that have already been concluded.
7. Security deposit
One day before the start of the rental period, a security deposit of EUR 500.00 will be reserved (but not charged) on the payer’s credit card. In the event of damage, this serves as security for the landlord. If the landlord reports no damage during the rental period and no new damage is discovered during the final inspection, the deposit will be released no later than 5 days after the last day of the holiday.
8. Payment terms
Upon booking, a deposit of 40% becomes due and will be charged directly to the tenant’s credit card via the payment system. The remaining amount will be charged to the credit card on file 30 days before the start of the rental period. The tenant will receive a corresponding notification. If the booking is made at short notice, meaning less than 30 days before the start of the holiday, the full rental amount becomes due.
Travel insurance including cancellation cost coverage can help prevent unpleasant surprises.
9. Cancellation terms
Cancellation by the tenant must be made in writing exclusively by email to welcome@nastevillas.com. Deposits already paid will not be refunded. If cancellation takes place within the final 30 days before the start of the rental period, the full rental price remains due. An exception applies if the tenant who is unable to travel arranges an adequate replacement tenant for the same period and the payment procedure, as described in the payment terms, has been initiated with the new tenant. In this special case, an administrative fee of 20% will be charged and becomes due.
In the event of early departure during the rental period, no refund will be made by the landlord.
10. Provisions on the day of arrival and departure
Contrary to the current common practice of using key boxes, we would like to welcome our guests personally. This helps guests find their way around the house and also allows useful information to be provided and/or requested on site. To ensure that the reception can be organised optimally, the tenant must inform NASTE VILLAS of the approximate arrival time 7 days before the start of the rental period by email. We kindly ask our guests to notify us of any delays on the day of arrival, such as flight delays, by WhatsApp, telephone or email.
The following check-in time applies:
Check-in: 4pm
As with check-in, we would also like to accompany our guests at check-out. It is important to us to say goodbye to our guests personally and to carry out a joint inspection of the rental property. This allows any damage to be inspected together and disputes to be avoided.
Please inform us of the departure time at the start of the rental period so that we can plan sufficient time on our side. During the inspection, we are also happy to give our guests a small giveaway for their journey home, intended as a reminder of their time at Rahajärvi.
The following check-out time applies:
Check-out: 11am
Guests may not assert any claims for damages against us for possible delays on our part during check-in due to unforeseen events, such as storms, accidents, etc. If the check-in or check-out times are not observed, NASTE VILLAS may charge the corresponding costs incurred.
11. Rental property
The holiday home will be handed over to our guests by us in a tidy and clean condition, with a complete inventory. Since we carry out an inspection during check-in, there should be no further defects that have not been discussed. Should this nevertheless be the case, contrary to expectations, such defects must be reported to NASTE VILLAS immediately and within 24 hours after the start of the rental period. Defects reported later shall otherwise be deemed to have been caused by the tenants. For this reason, a deposit of
EUR 500.00 is required (see point 7 for details).
Guests are liable for any damage caused by them to the rental property, the inventory, such as dishes, floors or other furniture, as well as to the outdoor equipment provided, such as boat, SUP, kayak, grill, etc. Special mention should be made here of the whirlpool. Use is at your own risk and is prohibited for people with compromised immune systems, as – despite professional maintenance – the presence of bacteria in the pool can never be ruled out. Guests must also bear the costs of lost keys.
The inventory must be treated with care and is intended to remain in the holiday home. Moving furnishings such as beds, sofas, tables, etc. is expressly not desired and is prohibited. Damage caused by force majeure is, of course, excluded.
In the event of use of the holiday home contrary to the contract, such as subletting, over-occupancy, disturbance of domestic peace, excessive noise, etc., the contract may be terminated without notice and the guests must leave the house. No refund of the rental price will be made.
A strict smoking ban applies throughout the entire house due to fire detectors. If the smoking ban is not observed, we must charge guests in full for any damage of any kind caused in this connection. This also applies in the event of a fire brigade call-out triggered by the alarm.
12. Pets
Unfortunately, pets are not allowed. Any violation may result in termination of the contract without notice, and any damage or cleaning work may be charged to the guests.
13. Withdrawal & liability of the landlord
If NASTE VILLAS has to cancel the rental of the house due to force majeure or other unforeseeable circumstances, even at short notice, only the payments already made by the guest at that time will be refunded. No further claims by the tenant may be asserted, such as travel or hotel costs, etc
Liability is also excluded for failures or disruptions in the water, electricity, TV and mobile networks, including WLAN, due to force majeure.
14. Provisions on the use of internet access (WLAN), liability
NASTE VILLAS provides internet access via WLAN in its holiday home. Our guests may use this access during their stay; however, they may not pass on either the access itself or the access data, including login details and passwords, to third parties.
The use of WLAN does not apply to websites or portals that are unlawful and could result in penalties. We assume no liability for damage resulting from WLAN outages, misuse through data transfer to or from third parties, viewing of data by third parties, hacker attacks, etc. We point out that no firewall or virus protection is installed. Use of the WLAN by our guests is at their own risk.
15. House rules
We refer here to the separate rental agreement concluded between the tenant and the landlord for the duration of the stay. These GTC form part of the rental agreement.
16. Data protection
We refer here to the separate data protection provisions, which our guests can also find on the website.
17. General provisions
These GTC are deemed to have been read and accepted in full by our guests upon completion of the booking and payment of the 40% deposit. Provisions that may unintentionally not have been mentioned or may have been forgotten are also deemed accepted hereby (severability clause).
During your stay, you are responsible for clearing the snow around the house. Shovels and other equipment are provided. We will clear the snow around the property before your arrival.
18. Disclaimer
Use of the equipment/device provided is entirely at your own risk. Any liability on the part of the owner/lessor for personal injury, property damage or financial loss arising in connection with the use of the equipment is expressly exluded to the extent permitted by law. This applies in particular to damage caused by improper operation, failure to observe safety regulations or technical failure.
19. Place of jurisdiction
Finnish law applies as the basis for any disputes arising from the contractual relationship, and such disputes shall be handled before the locally competent court.
